Missouri Supreme Court declares caps on damages in medical malpractice cases are unconstitutional

In a 4-3 decision issued today, the Supreme Court of Missouri has found that caps on the amount of money a person can win in medical malpractice lawsuits are a violation of the right to a jury trial.  The $350,000 damages cap had been put in place in 2005 by the Republican-led legislature as part of a massive tort-reform bill.  The case is called Watts v.
