UPI.com is reporting today that President Obama has distributed a memorandum to the heads of executive departments and agencies in which he states that "(The) general policy of my administration (is) that pre-emption of state law by executive departments and agencies should be undertaken only with full consideration of the legitimate prerogatives of the states and with a sufficient legal basis for preemption." This is, of course, a break from the approach of the previous administration which pursued and supported preemption on a massive and unprecented scale. Full story
